December Surprise n°3 - Game rules

ARTICLE 1: ORGANIZING COMPANY
The FAUCHON company, registered in the Paris Trade and Companies Register under number 326 315 462, with its head office at 8, rue Volney, 75002 Paris,
FAUCHON is organizing a free game with no obligation to buy, valid from December 15 to 21, 2024, entitled Surprise de décembre 3, the terms and conditions of which are described in these rules (hereinafter the “Rules”).


ARTICLE 2: PARTICIPANTS
The Contest is not open to members of staff (managers, employees, trainees, directors and permanent and occasional employees or associates) of the Organizing Companies and their families and spouses.
The Organizing Body reserves the right to ask any Participant to provide proof of eligibility. Any Participant failing to meet the conditions or refusing to provide proof will be excluded from the Contest and will not be entitled to a prize under any circumstances.

ARTICLE 3: PRINCIPLE AND TERMS OF THE GAME
To take part in the Game, the Participant must complete the following steps:
1. Place an order on the www.fauchon.com website between December 15 at 00:00 and December 21 at 23:59.
2. Enter his or her e-mail address when placing the order and agree to receive e-mail communications from FAUCHON.

Incomplete or late entries will be considered invalid.
Contributions to the Game containing, in particular, and not exhaustively, the following are prohibited:
- Offending human dignity;
- Sexually explicit or suggestive, pornographic, erotic or pedophilic;
- Apologizing for crimes of deliberate attacks on life, personal integrity or sexual aggression as defined by Book II of the French Penal Code (rape, indecent assault, public outrage, indecent assault, sexual harassment, etc.);
- Apology for war crimes, crimes against humanity or crimes of any kind whatsoever;
- Discriminatory, hateful or violent towards a person or group of people because of their origin, their membership or non-membership, real or assumed, of a particular ethnic group, nation, race, sexual orientation, profession, age group or religion;
- of a defamatory, insulting, libelous, racist or xenophobic nature.

ARTICLE 4: DESIGNATION OF WINNERS AND PRIZES
For this Game, one (1) Participant will be drawn at random by the Organizing Body (hereinafter referred to as the “Winner”).
As of December 24, 2024, the Winner will be selected and notified of his/her victory by e-mail. The Winner will receive the prize directly by e-mail.
The prize is :
- A gift card worth €300, valid for 12 months from the date of receipt only on the www.fauchon.com e-commerce site.
The Organizing Body does not guarantee any message intended to inform other participants that they have lost.
The Organizing Body shall not be held responsible in the event that the Winner cannot be reached by e-mail within the allotted time for a reason beyond their control or do not follow the instructions stipulated in the Rules.
For the purposes of awarding the Prize, the Winner authorizes the Organizing Body to carry out any and all checks concerning his/her identity or place of residence.

ARTICLE 5: MODIFICATION OF THE RULES AND LIABILITY OF THE ORGANIZING COMPANY
The Organizing Body reserves the right to modify the present Rules if necessary, and to make any decisions it may deem useful for the application and interpretation of the Rules, subject to informing the Participants.

ARTICLE 6: PRIVACY - PERSONAL DATA
In accordance with the provisions of Regulation n°2016/679, known as the General Data Protection Regulation, personal data collected by The Organizing Body, for the purpose of managing entries and designating the Winner, will be kept for a period of 3 (three) years. Participants may exercise their right of access, rectification, limitation, opposition and deletion by contacting FAUCHON: https://www.fauchon.com/pages/contact.

ARTICLE 8: ACCEPTANCE OF THE RULES
Participation in the Game implies full acceptance of all the provisions of these Rules by the Participant. In the event of any problem relating to the interpretation of the clauses of the present Rules, as well as in all cases of unforeseen difficulties, the dispute will be settled by the Organizing Body.
Should one or more provisions of the present Rules be declared null and void or inapplicable, the other clauses shall retain their full force and scope. All cases not provided for in these Rules shall be settled by the Organizing Body, whose decisions shall be final.


ARTICLE 9: LIABILITY
The Organizing Body may not be held liable in the event of malfunction of the “Internet” network preventing access to the Game or its proper conduct, in particular in the event of any external acts of malice, interruptions, network incidents, technical incidents, etc...
The Organizing Body may not be held liable for any error in the data provided by the Participant. In particular, the Organizing Body invites the Winner to check that the number and address given are correct and up to date.
The Organizing Body may not be held liable for any prejudice of any kind (personal, physical, material, financial or other) arising from a player's participation in this game.

ARTICLE 10: APPLICABLE LAW AND JURISDICTION
Any dispute arising in connection with this Game shall be subject to an attempt at amicable settlement. Failing agreement, the dispute will be subject to French law and the jurisdiction of the Paris Courts.
